By accessing or using Orchestera, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the platform.

2. Description of Service

Orchestera provides a managed Apache Spark cluster platform that operates within your AWS account. We automate cluster lifecycle management, including orchestration, autoscaling, monitoring, and infrastructure maintenance.

3. Your AWS Account

You must provide valid AWS credentials to use Orchestera. You are responsible for:

• All AWS costs incurred by your Spark clusters

• Maintaining appropriate AWS IAM permissions

• Compliance with AWS terms of service

• Security of your AWS account credentials

4. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials

• All activities that occur under your account

• Notifying us immediately of any unauthorized access

• Ensuring your use complies with applicable laws

5. Billing and Payment

Orchestera charges subscription fees for platform access. AWS infrastructure costs are billed directly to your AWS account. We do not charge any markup on compute resources. All fees are non-refundable unless otherwise stated.

6. Acceptable Use

You agree not to:

• Use the platform for any illegal purposes

• Attempt to gain unauthorized access to our systems

• Interfere with or disrupt the platform or servers

• Reverse engineer or attempt to extract source code

• Resell or redistribute the service without permission

7. Service Availability

While we strive for high availability, we do not guarantee uninterrupted access to the platform. We may perform maintenance, updates, or modifications that temporarily affect service availability.

8. Intellectual Property

The Orchestera platform, including all software, documentation, and content, is owned by Orchestera and protected by intellectual property laws. You retain ownership of your data and configurations.

9. Limitation of Liability

To the maximum extent permitted by law, Orchestera shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption.

10. Termination

We may terminate or suspend your account immediately if you violate these terms. Upon termination, your right to use the platform ceases immediately. You may cancel your account at any time through the platform settings.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of significant changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the new terms.
